Welcome to SodaPop Cool. These Terms of Service ("Terms") cover how you use our website at www.sodapopcool.com (the "Site") and everything you order from us. We've kept them as plain and honest as we can — but they're still the real agreement between you and us, so please give them a read.

SodaPop Cool is operated as a sole proprietorship by David Robel, based in California ("SodaPop Cool," "we," "us," or "our"). Questions about anything here? Email Support@SodaPopCool.com — we read every one.

Agreeing to these Terms

By browsing the Site or placing an order, you're agreeing to these Terms and to our Privacy Policy. If you don't agree with them, that's okay — but please don't use the Site or buy from us.

Who can shop with us

You need to be at least 18 years old, or old enough to form a binding contract where you live, to place an order on your own. If you're younger than that, you're welcome to shop with a parent or guardian who agrees to these Terms on your behalf. By ordering, you're confirming the information you give us is accurate and that you're allowed to use the payment method you're using.

How our products are made

Here's the part that makes us a little different: everything we sell is made to order. When you buy a hoodie, tee, or sweatshirt, it's printed and assembled just for you by our production partner — nothing is pulled off a shelf. That's what lets us offer real designs in real sizes without guessing what'll sell.

Because each piece is made individually, please expect small, natural variations: print placement, color, and sizing can shift slightly from one item to the next and from what you see on screen. Screens also render color differently than fabric does. These small differences are part of how made-to-order goods work — they aren't defects. (If something actually arrives wrong or damaged, that's a different story, and we've got you — see Returns below.)

Prices and product info

All prices are in U.S. dollars and don't include tax, which is calculated at checkout where applicable. We work hard to describe our products accurately, but we can't promise that every description, image, price, or detail is completely free of errors.

If we find a mistake — a wrong price, an inaccurate listing, or an item that's no longer available — we may correct it, and we reserve the right to cancel or refuse any order (including after it's placed) if that happens. If we cancel an order you've already paid for, we'll refund you in full. We may also limit or refuse orders that look like they're for resale or that we suspect are fraudulent.

Payment

Payment is due at the time you place your order, through the payment options offered at checkout. By entering your payment details, you're confirming you're authorized to use that method. Payments are handled by third-party processors, and we don't store your full card details ourselves.

Shipping and delivery

We currently ship within the United States only. Shipping costs and timing are described on our Shipping Policy page. In short: a flat rate on your first item, a smaller flat rate on each additional item, and free shipping on orders of $49 or more.

Because items are made to order, please allow production time before your order ships. Once a package leaves our production partner, delivery timing is in the carrier's hands. We'll always help you track down a wayward package — see our Returns & Exchanges policy for how we handle lost or undelivered orders.

Returns, exchanges, and refunds

Our full Returns & Exchanges policy is the final word on this, and it's a fair one:

If something's wrong on our end — wrong item, damage in shipping, or a print that isn't right — we'll send a free replacement or a full refund, and you won't pay to ship anything back.
If you ordered the wrong size or changed your mind — reach out within 30 days of delivery and we'll set you up with 110% store credit once the item comes back unworn and in original condition. We're not able to offer cash refunds in those cases, because made-to-order is what keeps our prices fair.

Our designs belong to us

The designs, artwork, logos, text, and overall look of SodaPop Cool and the Site are owned by us or our licensors and are protected by intellectual-property laws. You're welcome to enjoy them on the products you buy — but you can't copy, reproduce, resell, or use our designs or brand for your own commercial purposes without our written permission.

Using the Site fairly

When you use our Site, please don't: break any law; try to interfere with, hack, or overload the Site; scrape or harvest data; impersonate anyone; or use the Site to send spam or harmful code. We may suspend or cut off access to anyone who does.

Anything you submit

If you send us content — a review, a photo, a comment, an idea — you're giving us permission to use, display, and share it in connection with our business, and you're confirming it's yours to share and doesn't break any law or anyone's rights. Please keep submissions respectful; we can remove anything at our discretion.

Third parties

We rely on trusted partners to run our business — including our production and fulfillment partner, our e-commerce platform, payment processors, and analytics and marketing tools. The Site may also link to other websites we don't control. We're not responsible for the content, policies, or practices of third-party sites, so have a look at their terms before you use them.

The "as is" part

We do our honest best, but the Site and our products are provided "as is" and "as available," without warranties of any kind beyond those the law requires and won't let us waive. We don't guarantee the Site will always be available, error-free, or secure.

Limitation of liability

To the fullest extent allowed by law, SodaPop Cool and David Robel won't be liable for any indirect, incidental, or consequential damages arising from your use of the Site or our products. Where liability can't be excluded, our total liability to you is limited to the amount you paid for the order in question. Some states don't allow certain limitations, so parts of this may not apply to you.

Indemnification

You agree to cover and hold us harmless from any claims, losses, or costs (including reasonable legal fees) that come out of your misuse of the Site, your violation of these Terms, or your violation of any law or third-party right.

Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute that can't be worked out directly will be handled in the state or federal courts located in California, and you agree to that jurisdiction. Of course, we'd always rather sort things out with a quick email first.

Changes to these Terms

We may update these Terms from time to time. When we do, we'll change the "Last updated" date above, and the updated version applies as soon as it's posted. If you keep using the Site after that, you're agreeing to the changes.
